Definitions
In this Policy:
“Personal Information” means any information about you that can be used to identify you, directly or indirectly, or that relates to you, describes you, or can reasonably be associated with you, directly or indirectly. If you reside in Canada, this includes the meaning provided under the Canadian federal and provincial privacy laws that apply to you [for example, where applicable, the Act respecting the protection of personal information in the private sector, as amended by Law 25]. If you reside in the United States, this includes the meaning provided under the privacy law or laws that apply to you [for example, where applicable, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA)], and that meaning may vary by state.
“Privacy Laws” means all applicable laws relating to privacy and the protection of Personal Information.
“Sensitive Personal Information” means Personal Information that is considered sensitive under applicable Privacy Laws, such as Personal Information concerning racial or ethnic origin, health or medical history, government identifiers, and financial information.
Our Privacy Policy
As part of their recruitment processes, Boutique la Vie en Rose Inc., la Vie en Rose USA Inc., and their brands and banners, including “la Vie en Rose,” “Bikini Village,” and “Newex” (collectively, “la Vie en Rose/Bikini Village,” “we,” “us,” or “our”), collect, use, retain, and disclose Personal Information concerning applicants for employee positions, as well as non-employee positions such as internships and student positions (“you” or “your”).
This Privacy Policy (the “Policy”) describes the Personal Information we collect about you and how we use, retain, protect, and disclose that information.
The Policy also describes your rights regarding that Personal Information.
This Policy applies to individuals who apply for a position with la Vie en Rose/Bikini Village located in Canada or the United States, subject to the jurisdiction-specific provisions for Canada or the United States described below. Our recruitment activities are not directed at individuals located outside Canada and the United States. If you are located outside Canada and the United States, you submit your application voluntarily and acknowledge that we collect, process, and retain Personal Information collected in connection with your application in accordance with the applicable Privacy Laws of Canada or the United States, as the case may be, and that the Privacy Laws in force in Canada or the United States may not provide the same level of protection as the Privacy Laws applicable in your country or jurisdiction.
If you obtain employment with la Vie en Rose/Bikini Village, Personal Information about you collected under this Policy will be subject to our Employee’s Privacy Policy and any other relevant internal policy or code.
What personal information we collect
We collect the following categories of Personal Information about applicants, either directly from the applicant, through references provided by the applicant, from our service providers, such as recruitment, application-management, and/or background-check service providers, or from professional social media networks such as LinkedIn or Indeed. If you are a current or former employee of la Vie en Rose/Bikini Village and apply for a new or different position within la Vie en Rose/Bikini Village, we may also collect Personal Information about you retained by la Vie en Rose/Bikini Village in accordance with this Policy. The specific Personal Information we collect about you as an applicant will depend on your stage in the application process, and not every category of Personal Information listed below is collected for every applicant:
Identifiers
- • Your name(s), mailing address(es), and contact details, such as telephone number and email address, and your driver’s license (if driving is required for the position in question)
- • Your online identifiers, such as the IP address or device information collected by our online application systems
Professional or Employment-Related Information
- • Personal Information provided in your curriculum vitae (CV) and cover letter, where applicable, including your qualifications, skills, spoken languages, prior professional experience, employment history, and professional references;
- • Personal Information provided during interviews (by telephone, video, or in person);
- • Your professional memberships, certifications, diplomas, distinctions, and licenses.
- • Personal Information relating to past, current, or desired compensation;
- • Personal Information about you disclosed to us by the references you provided.
Education Information
- • Your academic records, transcripts, and/or academic achievements or awards;
- • Your diplomas, certificates, or credentials obtained.
Contact Information
- • Your residential and/or mailing address, telephone number, and email address
Sensitive Personal Information
- • Personal Information relating to your authorization to work for la Vie en Rose/Bikini Village, such as your citizenship, residency status, immigration status, or work permit (collected only where legally permitted and with appropriate consent);
- • Your driver’s license (if driving is required for the position in question);
- • Where permitted by Privacy Laws, Personal Information relating to diversity, equity, and inclusion that you voluntarily provide with your express consent;
- • For certain positions, and where permitted by applicable law, information concerning your criminal record may be processed, where applicable.
Internet or Network Activity Information
- • Personal Information, including metadata, automatically collected when you interact with our online careers’ portal or application tools, such as IP address, device type, browser type, and cookies that reveal visitors’ date and time of visit, location, and pages viewed.
Other Information
- • Personal preferences, hobbies, willingness to travel or relocate, or social preferences voluntarily shared in your application materials or during interviews;
- • Personal Information obtained from employment websites or recruitment services (for example, LinkedIn, Indeed, etc.) that have your consent to disclose that Personal Information to other parties, such as us;
- • Personal Information collected for security or fraud-prevention purposes, in accordance with law;
- • Personal Information provided in your communications with us
- • Any other information that you voluntarily provide to us or our service providers during the recruitment process.
Why do we Use Your Personal Information?
We and our service providers collect and process your Personal Information described in this Policy to establish an employment relationship with you and, in particular, for the following purposes:
- • Conducting initial applicant assessments, which may include reviewing employment history and the results of applications received;
- • Assessing your suitability for the position for which you are applying and evaluating your professional skills;
- • Complying with legal and regulatory obligations and processes;
- • Preventing and investigating security incidents or fraud;
- • Communicating with you about the recruitment process and contacting you about employment opportunities (if you have consented to receive such communications);
- • Conducting surveys about our recruitment process and improving our recruitment processes and practices;
- • Verifying your references and background;
- • With your consent, where required by Privacy Laws, retaining records for future employment opportunities with la Vie en Rose/Bikini Village.
With Whom and Why do We Share Your Personal Information?
We disclose your Personal Information to the following entities, as applicable:
- • Our affiliates: depending on where you reside, we may share your Personal Information with our affiliates located outside your country of residence (Canada or the United States, as applicable) to conduct the recruitment process or prepare internal reports;
- • Third-party service providers: to assess your application, we may disclose your Personal Information to third-party service providers that provide services to us in connection with recruitment and application management, such as recruitment software providers, background-check service providers, and recruitment consultants. Where applicable, we may also consult legal advisers and disclose your Personal Information to them in connection with our legal obligations;
- • Employers and references: to verify your employment history and check the professional references provided, we may disclose your Personal Information to your current and former employers and to the persons you identified as references;
- • Public bodies: to comply with our legal obligations or regulatory requirements, or where permitted by applicable laws and regulations, we may be required to disclose your Personal Information to government bodies or public authorities or institutions, such as labour authorities, courts, or law-enforcement agencies. In such cases, we will try not to disclose more Personal Information than is necessary in the circumstances;
- • Legal advisers and experts: we may be required to disclose your Personal Information to other parties, such as legal advisers, consultants, and external experts, to establish, exercise, or defend our rights in connection with claims, litigation, or settlements;
- • Parties to business transactions: where permitted by and in accordance with Privacy Laws, we may disclose your Personal Information to third parties in connection with a business transaction, such as a merger, acquisition, consolidation, liquidation, reorganization, sale or transfer of assets, or insolvency proceeding;
- • Other recipients with your consent: we may also disclose your Personal Information to any other third party where you have consented to such disclosure if Privacy Laws require that consent.
Retention of your Personal Information
La Vie en Rose/Bikini Village will retain your Personal Information for as long as necessary to fulfil the purposes described in this Policy, including for periods consistent with applicable legal and regulatory requirements governing access to that Personal Information, so that we can comply with our legal obligations worldwide.
Retention periods vary depending on the purposes. For example, we may retain Personal Information for a longer period where an extended retention period is required or permitted by applicable law. In certain special circumstances, we may also retain your Personal Information for extended periods to maintain an accurate record of your interactions with us in the event of disputes, complaints, or challenges.
Crossjurisdictional transfers
Your Personal Information may be transferred, used, accessed, and/or stored in secure locations and on servers controlled by la Vie en Rose/Bikini Village or its service providers located in various jurisdictions, for the same purposes described in the “PROTECTING YOUR PERSONAL INFORMATION” section. Accordingly, your Personal Information may be transferred, used, accessed, and/or stored outside your country, province, or state of residence, including outside the province of Québec. Those jurisdictions may not provide levels of Personal Information protection equivalent to those in your country, province, or state of residence. When we transfer your Personal Information between jurisdictions, we ensure that it is handled securely in accordance with this Policy and applicable law. Sources of Personal Information
We collect Personal Information about you directly from you and/or from your references and former employers; automatically through cookies or similar technologies; and from professional organizations, educational institutions, social media platforms, service providers, and third parties that help us assess and onboard individuals for recruitment purposes, including providers of recruitment and application-management software and background-check services. We also collect Personal Information from public records and institutions and, where applicable, from our affiliates.
Protecting your Personal Information
La Vie en Rose/Bikini Village works with suppliers and partners located around the world. Personal Information laws and regulations may differ from one jurisdiction to another. However, la Vie en Rose/Bikini Village takes measures to ensure that all its partners and suppliers comply with the Personal Information protection standards set out in this Policy and that your Personal Information is secured using appropriate methods. Please contact us if you would like more information about how we protect your Personal Information.
La Vie en Rose/Bikini Village uses appropriate physical, technical, and organizational measures to secure the Personal Information it receives, including protecting it against unauthorized or unlawful access or processing and against accidental loss, destruction, or damage by entering into contracts with our technology providers, implementing security and Personal Information protection policies, training our employees, protecting our network, keeping technology current, applying the latest security patches, limiting access to distribution rooms, and restricting access to Personal Information in technology solutions.
However, no method of protecting Personal Information can guarantee absolute security. Although we use appropriate security measures once we receive your Personal Information, transmitting information over the Internet is never completely secure, and we therefore cannot guarantee that your Personal Information will remain protected in all circumstances.
Exercising your rights
Bikini Village would like to make sure you are fully aware of all your data protection rights. Every user is entitled to the following:
La Vie en Rose/Bikini Village wants to ensure that you are fully informed of your Personal Information protection rights under the Privacy Laws applicable in the province or state where you reside. Please note that, depending on where you reside, some or all of these rights may or may not be available to you. At our sole discretion, we may choose to grant you these rights even where the laws applicable in your province or state do not require us to do so, but we reserve the right to deny requests not required by applicable law. Please see “ADDITIONAL INFORMATION FOR CALIFORNIA RESIDENTS” to determine the rights that apply to applicants residing in California.
- • Right to know: You have the right to know what Personal Information we have collected about you and to access it, as well as to know how that Personal Information is used and shared.
- • Right of access: You may request confirmation as to whether your Personal Information is being processed and, if so, access it and be informed of the applicable retention periods. You have the right to know the categories of third parties with which we have shared your Personal Information. If you reside in Québec, you have the right to know whether your Personal Information is disclosed outside the province and the categories of third parties to which it is disclosed.
- • Right to correction: You may request that we correct any Personal Information we hold about you that you believe is inaccurate.
- • Right not to be subject to automated decision-making: You have the right not to be subject to an automated decision that has a legal or significant effect. la Vie en Rose/Bikini Village may from time to time use automated tools to facilitate application management and the recruitment process. However, all decisions we make about your application are made by humans, and there is always meaningful human involvement in our use of these automated tools. Where la Vie en Rose/Bikini Village uses such automated tools to process and manage your Personal Information and you have consented to that use, you may request an explanation of the reasons and the principal factors and parameters that led to the decision and/or submit observations and request human review of the decision.
- • Right to non-discrimination: We will not discriminate against you for choosing to exercise your Personal Information rights.
- • Right to deletion: You have the right to request deletion of the Personal Information we hold about you, subject to certain conditions and exceptions. However, please note that we may deny such a request if, for example, we must retain the Personal Information to comply with our legal obligations.
- • Right to data portability: Applicants residing in certain jurisdictions, including the province of Québec, may request to receive their Personal Information in a structured, commonly used, machine-readable format and have it transmitted to one or more third parties.
- • Right to lodge a complaint: You also have the right to lodge a complaint with the competent supervisory authority in your jurisdiction, in accordance with applicable law.

Withdrawal of consent does not affect the lawfulness of processing and/or disclosure carried out before the withdrawal.

If you reside in the United States, you may also submit a request to access or delete your Personal Information, or withdraw your consent, by completing a request form.
We are committed to responding within the time limits prescribed by applicable law. If, after review, we determine that applicable law does not grant you the requested right and we choose not to act on your request, we will provide the reasons for the denial. In all cases, we will inform you of the outcome and the reasons.
Please note that we may need to verify your identity before processing your request. We generally do not charge a fee for exercising your rights unless the law permits us to do so where the request is manifestly unfounded, excessive, or repetitive. In that case, where permitted by applicable law, we may charge a reasonable fee or refuse to act.
Where permitted by applicable law, we may also refuse to act on such a request. In all cases, we will inform you of our decision and the reasons for it. Please do not provide Sensitive Personal Information in connection with a Personal Information rights request, such as a driver’s license, Social Insurance Number, or other government-issued identification.
Please note that we may not be able to respond to your Personal Information rights request without verifying your identity. If you reside in a province or state that gives you the right to authorize another person (an “authorized agent”) to submit a Personal Information rights request and you wish to exercise your rights through an authorized agent, we may require proof that you gave that agent a power of attorney or that the agent otherwise has valid written authorization to submit the request on your behalf. Individuals may provide us with a signed and dated power of attorney designating the authorized agent as their representative.
To help protect individuals’ Personal Information and maintain security, we will take steps to verify the identity of anyone making a Personal Information request before granting access to Personal Information or acting on the request. If a requester asks us to provide specific pieces of Personal Information, we may, where permitted by law, require the requester to sign a sworn declaration and/or provide other appropriate proof of identity confirming that the requester is the person identified by the Personal Information that is the subject of the request. Authorized agents may initiate a request on behalf of an individual using the same methods described above.
Appeals
Depending on where you reside, you may have the right to appeal a decision we made concerning your Personal Information rights requests by emailing us at privacy@bikinivillage.com within a reasonable period after our decision or within the period prescribed by applicable law.
To submit your appeal, please use the same email address used for the original request and, if submitting by email, include “Appeal Request” in the subject line. In the body of the email, include your name, province or state of residence, contact information, and a detailed explanation of the reasons for your appeal. Please do not provide Sensitive Personal Information with the appeal request, such as a driver’s license, Social Insurance Number, or other government-issued identification.
We will generally attempt to respond to your appeal within 45 days or as required by applicable law, and we will notify you if we need additional time to finalize our decision on your appeal.
Changes
We may update this Privacy Policy from time to time to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons. If we make minor changes or updates to this Privacy Policy, we will revise the “LAST UPDATED” date of this Policy. If we make material changes to this Privacy Policy, we will provide additional notice, such as a message on the home page of our websites or a notification sent to the email address you provided. We encourage you to read this Policy carefully before or when submitting your application and to review this Privacy Policy regularly to stay informed about our Personal Information protection and security practices and your rights concerning your Personal Information.
Information about Minors Under 14 years of age
Our Careers page and recruitment processes are intended only for persons who are at least 14 years of age (or the higher minimum age required by applicable law for the position concerned). We do not knowingly collect Personal Information from persons under 14 years of age. If you are a parent or guardian and believe that we may hold information from or about a minor under 14 years of age, please contact us at privacy@bikinivillage.com.
Additionnal Information for California Residents
The California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act of 2020 (CPRA), and its related regulations (collectively, the “California Laws”), provide certain disclosures and notices concerning the collection, use, and sharing of Personal Information. This section applies only to applicants residing in California and is provided for transparency concerning the California Laws. To the extent the California Laws apply to us, the information and rights described in this section may apply. This section supplements the other information provided in this Policy. Please read our entire Policy for additional information about our Personal Information protection practices and your rights.
La Vie en Rose/Bikini Village does not “sell” (that is, in exchange for monetary or other valuable consideration) or “share” [that is, with third parties for cross-context behavioral advertising] your Personal Information, as those terms are defined under the California Laws.
The “WHAT PERSONAL INFORMATION DO WE COLLECT?” section above describes the categories of Personal Information about you that we collect, and the “SOURCES OF PERSONAL INFORMATION” section above describes the sources from which we collect that Personal Information. The “WHY DO WE USE YOUR PERSONAL INFORMATION?” section details the purposes for which we collect these categories of Personal Information. The “WITH WHOM AND WHY DO WE SHARE YOUR PERSONAL INFORMATION?” and “CROSS-JURISDICTIONAL TRANSFERS” sections describe how we disclose these categories of Personal Information to third parties and the categories of third parties to which that Personal Information is disclosed. Information about the periods for which we retain your Personal Information is also provided in the “RETENTION OF YOUR PERSONAL INFORMATION” section above. - • the right to request that we disclose what Personal Information we collect, use, disclose, share, and sell, if any, about you.
- • in certain circumstances, the right to request that we delete the Personal Information we collected about you.
- • the right to request correction of inaccurate Personal Information we maintain about you.
- • the right to request that we limit the use and disclosure of your Sensitive Personal Information.
- • the right not to be retaliated against or discriminated against for exercising your rights under the California Laws.

We may generally disclose, and in the preceding 12 months we have disclosed, for a business purpose (as that term is defined in the California Laws), the categories of Personal Information listed above in “WHAT PERSONAL INFORMATION DO WE COLLECT?” to the following categories of entities:
- • Our subsidiaries and affiliates;
- • Our service providers that we use to support our recruitment activities;
- • Other third parties, such as regulatory authorities, law enforcement, and other third parties in connection with legal requirements, and third parties in the context of a business transaction.
We do not use your Sensitive Personal Information for purposes other than those permitted by the CCPA, as defined in Cal. Code Regs. tit. § 7027(m).
